COMPENSATION FOR INTANGIBLE DAMAGE IN THE FORM OF ANNUITY AND AMOUNT INSURED
Abstract
This paper tries to analyze the institute of damages in the form of rent. After a brief presentation of the historical development of the institute of non-material damage and the institute of damages in the form of annuity, an analysis of the procedure and method of payment of life annuity is provided. Particular emphasis is placed on certain provisions accompanying the institute of damages in the form of annuity, and especially on the problems that arise in practice in the event that the insurance company pays out the entire insured sum. Attention is drawn to the advantages and disadvantages of such an institute, then a brief review is given of the legal consequences that follow the institute of lifetime annuity. Through the presentation of judicial practice and the position taken by the court regarding the foundation of this institute, the paper analyzes the importance of the payment of lifetime annuity, especially for the case of persons who are seriously physically injured and who need constant care and assistance. The result that this work aims to achieve is to make a contribution to a more complete and comprehensive overview of the legal issues that can be raised in connection with the institute of lifetime annuity.
